Welcome to Kaimetric. These Terms of Service ("Terms") govern your access to and use of the Kaimetric platform, including our website, applications, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
Please read these Terms carefully before using Kaimetric. If you do not agree with any part of these Terms, you may not use the Service.
"Kaimetric," "we," "us," and "our" refer to Kaimetric, the company operating the platform.
"You" and "your" refer to the individual or entity registering for and using the Service.
"Athlete Data" refers to any personal information, performance metrics, biographical details, or other data you enter into the platform about your athletes.
"Coach" or "Account Holder" refers to the individual or organization that creates and manages a Kaimetric account.
Kaimetric accounts are owned by the coaches, trainers, gyms, or organizations ("Account Holders") that create them. Each account is associated with one email address and one organization.
You must be at least 18 years of age to create and operate a Kaimetric account. By registering, you represent and warrant that you have the legal authority to enter into these Terms on behalf of yourself or your organization.
You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
Kaimetric is a software as a service (SaaS) platform designed for sports performance coaches. The Service allows coaches and trainers to:
The Service is intended for use by professional and amateur sports performance coaches, strength and conditioning specialists, athletic trainers, and similar professionals.
You retain full ownership of all data you enter into Kaimetric, including Athlete Data. We do not claim any ownership rights over your content.
By using the Service, you grant Kaimetric a limited, nonexclusive license to store, process, and display your data solely for the purpose of providing and improving the Service. This license terminates when you delete your data or your account is closed.
You acknowledge that the platform stores Athlete Data which may include personal information about minors. As the Account Holder, you are solely responsible for ensuring that you have proper authorization, including parental or guardian consent where applicable, to collect, store, and manage data about any individuals whose information you enter into Kaimetric. See our Privacy Policy for additional details.
New accounts receive a 14 day free trial with full access to all platform features. No payment information is required to begin a trial. At the conclusion of the trial period, you must subscribe to a paid plan to continue using the Service.
Kaimetric is offered on a monthly subscription basis. Subscription fees are billed at the beginning of each billing cycle. All fees are quoted in U.S. dollars unless otherwise stated.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us.
Subscription fees are generally nonrefundable. If you cancel before the end of a billing cycle, your access will continue through the end of the current billing period. We may, at our sole discretion, offer refunds or credits on an individual basis.
You agree to use Kaimetric only for lawful purposes and in accordance with these Terms. You agree not to:

Kaimetric recognizes that sports performance coaches frequently work with athletes who are under the age of 18. The platform allows the storage of biographical and performance data about minors.
As the Account Holder, you accept full responsibility for:
Kaimetric acts as a data processor on your behalf and stores minor Athlete Data at your direction. We do not independently collect personal information from children. For more details, please review our Privacy Policy.
The Service, including its design, code, features, documentation, trademarks, and all related intellectual property, is and remains the exclusive property of Kaimetric. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Service as described herein.
You retain ownership of your data and content. However, any feedback, suggestions, or improvement ideas you provide to us regarding the Service may be used by Kaimetric without obligation or compensation to you.
To the maximum extent permitted by applicable law, Kaimetric and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service.
In no event shall our total aggregate liability to you for all claims arising out of or related to these Terms or your use of the Service exceed the total amount you paid to Kaimetric in the twelve (12) months preceding the claim.
The Service is provided for performance tracking and data management purposes only. Kaimetric does not provide medical, athletic training, or professional coaching advice. You acknowledge that all training decisions and athlete management choices are your sole responsibility.
We do not guarantee that the Service will be uninterrupted, free of errors, or free from security vulnerabilities. We do not warrant the accuracy or completeness of any data, calculations, or analyses generated by the Service.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
You agree to indemnify, defend, and hold harmless Kaimetric and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
You may cancel your account at any time by contacting us or through your account settings. Upon cancellation, your subscription will remain active through the end of the current billing period.
We may suspend or terminate your account at any time, with or without cause, with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, failure to pay fees, or conduct that we believe is harmful to the Service or to other users.
Upon termination of your account, you will have 30 days to export your data. During this period, you may request a full export of your Athlete Data in a standard format (such as CSV). After 30 days, we reserve the right to permanently delete all data associated with your account.
The following sections survive termination: Data Ownership, Limitation of Liability, Disclaimer of Warranties, Indemnification, Dispute Resolution, and any other provisions that by their nature should survive.
Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve the dispute informally by contacting us. We will attempt to resolve the dispute through good faith negotiation within 30 days.
If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the state of North Carolina, unless both parties agree to a different location or to virtual proceedings.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. If this waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email at the address associated with your account or by posting a prominent notice within the Service at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue your use of the Service before the changes take effect.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kaimetric regarding the Service.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
Notices. We may send notices to the email address associated with your account. You are responsible for keeping your contact information current.
